fix(memory): retain record-free init templates and manual notes as opaque appended text, and include UTF-8 BOMs in preservation checks instead of silently stripping them

test: exercise legacy preservation, refusal without domain file changes, forced mutations, dry runs, fresh initialization and subsequent canonical writes through the actual CLI
